  1. The Planning Authority invites applications for the post of OFFICER V (ENFORCEMENT) - ENFORCEMENT OFFICER I
  2. Terms and Conditions
    1. indefinite employment subject to a successful probationary period of 6 months
    2. annual basic salary of €24,695 progressing to of €27,420;
    3. a performance bonus;
    4. flexi-time, reduced summer hours, family-friendly initiatives, health insurance, shut-downs and hybrid working;
    5. automatic progression to the higher grade, subject to satisfactory performance, reaching an annual basic salary of €29,399

  1. Duties and responsibilities

The duties and responsibilities of the position are:-

  • Regularly monitoring development underway to ensure that it takes place in accordance with conditions of permissions and approved drawings; issuance of compliance certificates, and detecting unauthorised development.
  • Ensuring the proper service of enforcement notices and carrying out regular visits to review activity following determination of development permission applications, recommending action where appropriate and maintaining all necessary case files, reports and system up-dates on enforcement information system.
  • Investigating complaints and alleged breaches of conditions imposed in development permissions and drafting of relative responses to complainants.
  • Giving advice to and conducting discussions/negotiations with those potentially in breach of planning control on appropriate measures to rectify/regularise position.
  • Preparing reports, taking photographs and compiling site histories including maintaining, up-to-date statistical information.
  • Liaising closely with the Development Management Directorate and obtaining advice as to whether remedial action is possible, or whether the development is wholly unacceptable in terms of current policies.
  • Liaising with other entities and if the case may propose enforcement action through the police and Planning Authority; representing the Directorate at legal hearings and following approval, liaising with all involved parties on the proposed remedial actions.
  • Exercising such powers as are embodied in planning and other related legislation to enforce the decisions of the Planning Authority; notifying periti and such other parties as may be involved of the remedial action or in appropriate cases, that the work must be stopped and the development removed.
  • Taking such action as may be necessary to recover payments due to the Authority by third parties, except for the physical handling of money, in all its forms.
  • Liaise closely with the Legal Office on procedures pertaining to Court cases and the Environment and Planning Review Tribunal, and give evidence where required, including the formulation and presentation of affidavits.
  • Carrying out related subsidiary and ancillary tasks within the normal flexibility of the job.

  1. Eligibility, Qualifications and Experience Required

4.1 By the closing date of this advert, applicants must be:

    1. citizens of Malta; or
    2. citizens of other Member States of the European Union who are entitled to equal treatment to Maltese citizens in matters of employment by virtue of EU legislation and treaty provisions dealing with the free movement of workers; or
    3. citizens of any other country who are entitled to equal treatment to Maltese citizens in matters related to employment by virtue of the application to that country of EU legislation and treaty provisions dealing with the free movement of workers; or
    4. any other persons who are entitled to equal treatment to Maltese citizens in matters related to employment in terms of the law or the above-mentioned EU legislation and treaty provisions, on account of their family relationship with persons mentioned in paragraph (a), (b) or (c); or
    5. third country nationals who have been granted long-term resident status in Malta under regulation 4 of the “Status of Long-Term Residents (Third Country Nationals) Regulations, 2006” or who have been granted a residence permit under regulation 18(3) thereof, together with family members of such third country nationals who have been granted a residence permit under the “Family Reunification Regulations, 2007”; or
    6. in possession of a residence document issued in terms of the “Residence Status of United Kingdom Nationals and their Family Members in Malta in accordance with the Agreement on the Withdrawal of the United Kingdom and Northern Ireland from the European Union and the European Atomic Energy Community Regulations”.

The advice of the Citizenship Unit within Community Malta Agency and the Expatriates Unit within Identita` should be sought as necessary in the interpretation of the above provisions.

The appointment of candidates referred to at (b), (c), (d) and (e) above would necessitate the issue of an employment licence in so far as this is required by the Immigration Act and subsidiary legislation. Jobsplus should be consulted as necessary on this issue.

By the closing date of this vacancy, applicants must be in possession of:

Six (6) recognised qualifications at MQF level 3, or other equivalent qualification, that include English or related subject.

OR

Four (4) recognised qualifications at MQF level 3, or other equivalent qualification, that include English or related subject, and a minimum of three (3) years experience in law enforcement.

OR

A diploma or other equivalent qualification at MQF level 5 in spatial planning, or architecture, or built heritage, or environmental or social sciences, or geography, or law, or criminology, or any other relevant subject.

Skills: Ability to communicate in verbal and written Maltese and English, be computer literate, and possess knowledge in drawing interpretation skills. Ability to withstand pressure, and act with tact and firmness in challenging situations.

Experience: Experience in customer care relations, and report writing will be considered as an asset.
